01General provisions
These Terms of Service set out the rules for using the your-web.pl website, the contact form, the cooperation plans and YourWeb Studio. The service provider is YourWeb Agency (“YourWeb”).
Contacting YourWeb:
- E-mail: kontakt@your-web.pl
- Phone: +48 660 790 373, +48 664 034 072
Terms used in these Terms of Service:
- Client: a natural person, legal person or organisational unit that uses YourWeb's services or concludes an agreement with YourWeb.
- Plan: a cooperation package described on the Pricing page: Basic, Professional, Premium or Enterprise.
- YourWeb Studio (Studio): a panel for managing the content of the Client's website (CMS).
- Project owner: the Client's account in Studio that manages the team and access.
- Editor: a person given access to Studio by the Project owner with an editor code.
02Electronic services and technical requirements
We provide the following services electronically and free of charge: making the website content available, the contact form and, under a concluded agreement, access to Studio.
To use the services you need a device with internet access, an up-to-date browser with JavaScript and the necessary cookies enabled and, for Studio, an active account.
It is prohibited to provide unlawful content or content that infringes the rights of third parties, and to take actions that disrupt the operation of the website or Studio.
03Contact form and enquiries
Sending the contact form or choosing a plan on the Pricing page is an enquiry, not an order. After receiving it, we get in touch to confirm the scope, timing and terms of cooperation.
The information on the Pricing page, including prices and the scope of the plans, is for information only and is not an offer within the meaning of the Polish Civil Code. Binding terms are set out in an offer confirmed by both parties or in an agreement.
A promo code entered in the form is verified when the order is confirmed. The rules of a promotion are set out in its description.
04Cooperation plans and conclusion of the agreement
The agreement is concluded when both parties confirm the scope and terms of cooperation, in documentary form (e.g. by email) or in writing.
The scope of a plan is defined by the Pricing in force on the day the agreement is concluded, together with any individual arrangements. Every plan includes access to YourWeb Studio with a Project owner account. Plans differ in, among other things, the number of pages, the number of additional Editor accounts (Professional: up to 2, Premium: up to 5, Enterprise: agreed individually), how often content is updated and the scope of design work, integrations and support.
Content updates made by YourWeb as part of a plan follow the agreed rhythm and are based on materials provided by the Client. Work beyond the scope of the plan requires a separate arrangement.
05Payments and billing
Cooperation includes a one-time setup fee and a plan fee billed monthly or annually, according to the chosen billing method.
The amount of the fees, information on VAT, and the payment deadline and method are given in the offer or the agreement. Payment is made on the basis of an invoice or another billing document.
If a payment is late, YourWeb may, after first requesting payment, suspend the work covered by the plan or access to Studio until the amount due is paid.
06YourWeb Studio: accounts and rules of use
YourWeb creates the Project owner account after the agreement is concluded. The Project owner can invite Editors with one-time editor codes, within the number of accounts included in the plan, and can grant and revoke their access.
Studio users undertake to protect their login details, not to share their account with other people and to inform us without delay if they suspect unauthorised access.
The Client is responsible for the content entered and published in Studio by its users. Saving a draft does not change the public website: changes become visible once they are published.
We may suspend an account that breaches these Terms of Service or threatens the security of Studio, and we will inform the Project owner about it.
07Content and copyright
The Client declares that it holds the rights to the materials provided to YourWeb and published on the website (texts, photos, logos) and that their use does not infringe the rights of third parties.
The scope of the Client's rights to the design, code and other works prepared by YourWeb, including a licence or a transfer of economic copyrights, is set out in the agreement.
08Availability and liability
We make every effort to keep the website and Studio running without interruption. Technical breaks may nevertheless occur due to maintenance, updates or infrastructure failures, including on the side of external providers. Where possible, we announce planned breaks in Studio in advance.
YourWeb's liability towards Clients who are not consumers is limited to actual damage, and its amount to the total fees paid for the 12 months preceding the event, unless the damage was caused intentionally. This limitation does not apply to consumers.
09Complaints
You can submit complaints about the services to kontakt@your-web.pl. Describe the problem, point to the page or feature it concerns and give your contact details.
We will respond to a complaint within 14 days of receiving it.
10Consumers and entrepreneurs with consumer rights
A consumer who has concluded a distance agreement may withdraw from it without giving a reason within 14 days of its conclusion by sending a statement to YourWeb's email address.
If, at the consumer's express request, we start providing the service before this period ends, a consumer who withdraws from the agreement pays for the services provided up to the moment of withdrawal. The right of withdrawal does not apply when the service has been fully performed with the consumer's express consent, after the consumer was informed before it started that they would lose this right once the service was performed.
The provisions on consumers also apply to a natural person concluding an agreement directly related to their business activity, if the agreement is not of a professional nature for them.
A consumer may use out-of-court methods of resolving disputes, including the help of a municipal or district consumer ombudsman or the provincial inspectorate of the Trade Inspection.
11Duration and termination of the agreement
An agreement for a plan is concluded for the period specified in the offer or the agreement. The rules and periods of notice are set out in the agreement.
When cooperation ends, access to Studio expires. Before it expires, the Client may ask us to hand over the content of its website.
12Personal data and cookies
The processing of personal data is described in the Privacy policy, and the use of cookies in the Cookie policy.
13Changes to the Terms of Service and final provisions
These Terms of Service may be changed for important reasons, for example changes in the law or in the scope of the services. We inform Project owners about changes concerning Studio at least 14 days before they take effect. Agreements concluded earlier remain subject to the previous provisions, unless the change is favourable to the Client.
Matters not covered here are governed by Polish law. These Terms of Service do not limit consumer rights arising from mandatory provisions of law.
